MOSHTIX TICKET REQUEST TERMS & CONDITIONS

These Ticket Request Terms and Conditions apply to requests to purchase tickets sold by Moshtix on Moshtix.com.au, where the Moshtix Ticket Request product ('Ticket Request') is made available for a particular event. These Terms and Conditions apply in addition to the Moshtix terms and conditions of purchase and any event specific terms.

These Ticket Request Terms and Conditions do not apply to general purchases of tickets on Moshtix.com.au by you, unless you purchase the tickets as a direct result of making a request through Ticket Request. If you purchase tickets through Moshtix.com.au that are not the subject of a request made by you, please refer to the Moshtix terms and conditions of purchase. If you purchase tickets through any other platform you will need to go to your place of purchase for any queries or support (including refunds).

Nothing in these terms and conditions is intended to limit or exclude Moshtix's liability, or the liability of an event organiser, under applicable consumer law including under the Australian Consumer Law and the Competition and Consumer Act 2010.

Eligibility and applicable terms: Moshtix Ticket Request is open only to natural persons. Tickets are for personal use only and are not to be used for any commercial purposes, including advertising or unauthorised promotions. Registration of a request constitutes your full and unconditional agreement to these Ticket Request Terms, the Moshtix terms and conditions of purchase, any event specific terms and Moshtix's or the relevant event organiser's decisions, which are final and binding in all matters related to Ticket Request. The selection and processing of requests is contingent upon fulfilling all requirements set forth herein and is not guaranteed.

Timing: The registration period for making a request, where Ticket Request is available on an event, begins and ends at the times and dates communicated on the relevant event page ("Registration Period").

Requests will be selected from the valid requests submitted during the Registration Period and selected requests will be processed at the times and dates communicated on the relevant event page or in your request confirmation email.

How To Register: During the Registration Period, follow these steps:

1. Go to the relevant event page and select the ticket price and type and the number of tickets you are requesting.
2. Next, you will be directed to provide your name and complete billing information, including your valid payment method details. You must provide your billing information during registration to participate in Ticket Request. This does not guarantee that you will be issued tickets.
3. If your request is selected, your payment method will be charged. If payment is successful, your purchase will be confirmed and you will receive an order confirmation email from Moshtix, and your tickets will be delivered to your registered email address. Please note that some events may utilise delayed ticket delivery and you may receive your tickets closer to the event date.
4. If your request is not selected or processed, you will receive an email with further information and instructions.

Cancelling your request: If you decide to cancel your request, you must follow the cancellation instructions in the request confirmation email and cancel your request before the requested purchase is confirmed. After a purchase is confirmed, the request is not able to be cancelled.

To modify a request, you will need to cancel your request and submit a new request, subject to the Registration Period still being open.

Effect of request registration: Making a request with Ticket Request does not guarantee purchase of tickets. You should only register for tickets that you are willing to purchase as your entire request may be successfully allocated to you, including across ticket categories, dates and events.

The event organiser may in its sole discretion determine the number of tickets it makes available for an event to fulfil requests made using Ticket Request. When the tickets available to fulfil requests made using Ticket Request have been exhausted, any unfulfilled requests may be cancelled without charge. We will notify you if your request has been cancelled.

Ticket Request Notification and Ticket Purchase Confirmation: Ticket requests will be selected at random to be processed. If your request is selected, the tickets will be charged to the payment method provided at time of registration. If payment is successfully processed, the purchase will be confirmed and you will then receive an order confirmation email with details and instructions about the event.

Decisions made by Moshtix and the event organisers as to the administration and operation of Ticket Request and the selection of requests for a particular event, in their sole discretion, are final and binding in all matters related to Ticket Request. Moshtix and the event organisers reserve the right to disqualify you and may refuse to process your request if you are deemed to be ineligible or to have violated any rule, gained unfair advantage in participating in Ticket Request or obtained confirmed status using fraudulent means.

Payment processing: When you submit a request, you will be required to provide your payment method details, which will be securely stored by Stripe for the purpose of processing payment if your request is selected.

If your request is selected, we will attempt to process payment once only using the payment method details provided by you. You are responsible for ensuring that you have sufficient funds available on your nominated payment method to process payment for your request in full. If insufficient funds are available and/or your payment method is declined, your request will be cancelled without charge. Payment processing will not be re-attempted.

Privacy: The information you submit during the Ticket Request registration will be collected in accordance with Moshtix's privacy policy located at https://www.moshtix.com.au/v2/faq/faq-privacy-policy. Stripe will receive for personal data for the purposes of collecting your payment method details and processing payment, if your request is selected, in accordance with Stripe's Privacy Notice located at https://stripe.com/au/privacy. You may withdraw your personal data upon request, however, you will be removed from Ticket Request and your request may not be processed if you withdraw your personal data prior to the selection of registrants and/or ticket purchase confirmation. Your participation in Ticket Request constitutes your consent for Moshtix to use your personal data to administer Ticket Request, and the processing of your purchase, if successful.

Errors and Unauthorised Activity: Except to the extent required by law or caused by Moshtix or the event organisers respectively, Moshtix and the event organisers are not responsible for: (1) any incorrect or inaccurate information, whether caused by you, printing errors, or by any of the equipment or programming associated with or utilised to administer Ticket Request; (2) technical and/or communications malfunctions, errors or failures of any kind; (3) unauthorised human intervention in any part of Ticket Request; (4) technical or human error which may occur in the administration of Ticket Request, including registration processing; (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in Ticket Request or receipt or use or misuse of any ticket purchase confirmation; or (6) if Ticket Request cannot take place or if any ticket cannot be provided due to acts of war, natural disasters, weather or acts of terrorism, or other conditions outside Moshtix or the event organisers' control.

Modifications to Ticket Request by Moshtix: Moshtix reserves the right to cancel, suspend and/or modify Ticket Request, or any part of it, if any fraud, technical failures, or any other factor beyond Moshtix's reasonable control impairs the integrity or proper functioning of Ticket Request, as reasonably determined by Moshtix.

Ticket Request tampering or violation of these Terms: Moshtix reserves the right, to disqualify you if it, acting reasonably, suspects or finds you to be tampering with the registration process or the operation of Ticket Request or to be acting in violation of these Ticket Request Terms or the Moshtix terms and conditions of purchase. Any attempt by you to deliberately undermine the legitimate operation of Ticket Request may be a violation of criminal and civil law, and, should such an attempt be made, Moshtix reserves the right to seek damages from you to the fullest extent permitted by law. Failure by Moshtix to enforce any term of these Ticket Request Terms shall not constitute a waiver of that provision.

Use of any automated technology or system to participate is prohibited and will result in disqualification. Moshtix and the event organisers are not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified.

Release: Moshtix does not by these terms exclude any rights and remedies in respect of goods or services under the Australian Consumer Law, or equivalent state or territory legislation which cannot be excluded, restricted or modified. By participating in Ticket Request, to the fullest extent permitted by law, you (a) release Moshtix, the event organisers and any promotion partners, and each of their respective parent companies, affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees, from any and all liability for any claims, costs, injuries, losses or damages of any kind arising in connection with Ticket Request, including the unauthorised or illegal access to personally identifiable or sensitive data, or acceptance, possession, use, misuse or non-use of the ticket purchase confirmation that may be provided to you; and (b) acknowledge that the foregoing parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to a ticket purchase confirmation or tickets, including without limitation the quality or availability.

Law and jurisdiction: These Ticket Request Terms and Conditions are governed by the laws of New South Wales, Australia.
